How annoying is this,I have a 30 acre field next to my house across the lane, I use it for my broodmares and have 7 acres behind the house that I use for the stallions and sec a ponies and a little paddock for new foals and mum, the farmer that owns the field above my 30 acres has put some tb's in there one has gone thro the fence and covered one of my mares and have now given my horses strangles, when I asked him had he had strangles recently, "yes thats why they're in there and not racing" !!!!!, he has moved the colt now saying "well I thought all yours were pregnant"! most of them are but I got 2 new ones earlier this year and didn't want them covered yet and not by some random horse, I am so cross at the moment, Mandy.

I would ask him to apy all vets fees relating to the mare he has covered and your others if they come down with strangles. Poeple have a duty to keep there animals securely in a field and also not to spread disease. Are you a BHS member? I so I would speak to their legal helpline right away. |

God that is annoying!
I would be a bit careful though about how you go about getting him to pay bills etc as I belive there is some bizarre law which states that the resulting foal of a stallions outbreak is actually the property of the stallion owner :o/ |

this happened to us a few years ago when a new forest pony colt got in with our mares as precaution we had them jabbed to abort foals and colt owner payed all vets costs!! srangles is i belive a notifieable disease, and it is correct that resulting foals would belong to stallion owner! good luck |

Hi, thanks for the info, strangles is notifiable, the vet suggested getting the 2 mares in question jabbed which I will do, they both have strangles and would probably abort, I don't want to leave it to chance or let the mares get even more ill by leaving them, I am very worried about the pregnant mares one is really unwell now, I have managed to find a towable shelter to put in the field and have put her in there, vet thinks it quite probable that she will foal early (she's due july) this will be the last foal of my stallion KILDALTON PRINCE that I lost last year to keratoma at age 12,I have had some advice from BHS, the farmer is basically saying "sod off" at the moment,I will keep you updated, Mandy. |

Strangles is not notifable under English law according to "The Horserace Betting Levy "Board www.hblb.org.uk. It has a "codes of practice on equine diseases" which can be downloaded and these are the requirements that most thoroughbred breeders usually adhere to and vets complying with their practices, to send mares off to stud, sales etc. Just for your information. If you are insured they probably have a solicitor engaged for this kind of dispute.

i would have a word with someone from the jockey club if i were you. he has a duty of care to the horses, but a responsibility to horses around his. who does the fencing belong to? if he has relied in your fening to keep his colt out when it is only adequate to keep in calm brood mares you can also get him on that score. he must by law make sure that all stock fencing is adequate for the stock that is being turned out. obviously it wasn't good enought to keep a colt in. also as said, strangles is a notifiable desease and so therefore the horses should not have been turned out next to other peoples horses. the bhs should be able to put you in touch with a very good equine solicitor, if not take to richard chamblin at the equine solicitor's registry and he will put you in touch with your local solicitor who should be able to get it all down in legal terms for him.

Hi, thanks for your help, I am with the NFU and they have a solicitor who will deal with this for me, the fence is mine, a good stock fence, I wouldn't put my stalloins in there tho' I shall leave the legal stuff to the solicitor now and look after my sick beasties, Mandy. |

Mandy I am so sorry to hear this dreadful news. I am horrified to learn that people knowingley turn horses carrying diseases out next door to other horses with no regard to what may happen. I hope this chap will have the decency to offer his help and support to you and the rest of your mares. |

Hi Mandy, I am so sorry to hear of your loss, if I can help you in any way please let me know, had to look after a yard full of stangles victims last year. I'm in Sussex. I don't know if you remember me, I came and saw Lily etc a few years ago (used to look after them when they were racing). Only just saw this post and am horrified, how awful for you and the horses! Please drop me a line, I would really love to hear how they all are, particularly Lily and Bella. Popped over to Little Brook the other day and couldn't help but wonder how you all were. Anna |

Oh Mandy - what a dreadful, dreadful thing to happen. Our hearts go out to you.
How totally irresponsible of your neighbour - he knowingly put sick horses next to a field of what he believed were pregnant mares. That is disgusting.
Hope things work out. |
