I paid £100 deposit to Kelly Mardell who is advertising on the geldings for sale pageof AL.
Now she refuses to let me collect and complete the sale nor will she refund my deposit.
I have taken legal anvice and she is in breach of contract so I have written and told her that but she will not communicte with me. I can also take her to court...
Has anyone else had dealings with her?

You have send a 7 day letter, stating that if she dose no return your deposit (send it recorded) you will take her to small calmed court. It will cost you about £30 be she will have to pay all costs including sending the letters and recorded post costs( cost about £25 for a letter and £6 for post). Go to your local court and they will give you a form, fill it in, add your interest at 8% per day including your fee for logging the clame. That will be to get most people to pay up.
Have you a receipt for the deposit! |

| Really sorry to read this, Faymouse. Any reason given by the vendor for her refusal to complete the sale and/or return your deposit? Very odd, not to say illegal, behaviour? |

| Yes I thought I'd seen them advertised before and I thought originally was the same seller but might be wrong. Noticed them because of the Sky breeding, can't be many of them about now |

Many years ago I saw some lovely rugs at an equine event, the lady made them herself and I ordered and paid for two. They didn't arrive and I had constant excuses, ran out of material, sewing machine broken down, family illness etc. In the end I sent her a letter telling her that if I had not received the rugs within fourteen days I would start small claims court proceeding against her. I still didn't get the rugs and no reply to my letter so I took her to the small claims court, she didn't turn up and I got my money back plus costs. If the defendant doesn't pay up you can take them back to court and they can eventually go to jail or have property seized unless that has changed since my court case.
Hope it doesn't come to that. |

| Ah I hadnt noticed the ad for sun spirit and it all seems odder still as she made a mention of two purebreds but why the other one under another name?? I feel less and less able to trust this person who gave me no reason for refusal to refund or sell just got aggressive and defensive :( It sad because if they were genuine horses I have an excellent Arab home to offer.. |

I did wonder that too possible scam as I have only seen pics so far :(
I have sent an email requesting refund within 7 days or will take it to court. I have taken legal advice from the BHS insurance line Prefer not to have the hassle but seems I must |

She has just sent me a text to say she will take me to court for slander I think she needs legal advice.. sorry but in my eyes and the eyes of the law you must either allow collection or refund. |

| FAYMOUSE, PLEASE PRINT OFF ALL THE ADVERTS TO BACK UP YOUR RECEIPT; not sure if you can print off the ones on here but I think in the circumstances admin would allow you to. It certainly seem as if you have been scammed and there are laws against that sort of thing. |

Well, if the wretched woman can text you about your alleged slander, which it isn't, because you are reporting the truth about her appalling behaviour, why can't she text to explain why she isn't refunding your money or allowing you to see the horse?  |
